What Is Litigation Funding?
Litigation funding is a form of third-party financing where litigation funders provide capital to support legal claims. Unlike traditional loans, litigation funding is typically structured as non-recourse financing, meaning repayment is contingent upon a successful resolution. The industry now represents a multibillion-dollar and rapidly growing segment of legal services, attracting major institutional capital and reshaping how high-value cases are pursued.
The funding can be used to cover various litigation-related expenses, including:
- Attorney fees and firm operating costs
- Expert witness fees and trial preparation expenses
- Case investigation and discovery costs
- Court filing fees and administrative expenses
- Appeals and enforcement proceedings
Litigation funding is case-specific and each arrangement is negotiated independently. The terms, including the funder's return and any conditions on the funding, vary based on a variety of factors, including, but not limited to, case strength, expected damages, timeline, jurisdiction, and recoverability. Specific terms may differ depending on the funder and case profile.

Why Attorneys Use Litigation Funding
Litigation funding enables attorneys to unlock capital, manage risk, and pursue high-value matters while reducing the strain of upfront costs. Attorneys often use litigation funding to:
- Improve cash flow: Access working capital to support case development, trial preparation, or firm operations without tying up internal resources
- Expand client representation: Pursue strong claims where clients may be unable to pay legal fees or cover litigation costs
- Enhance case selectivity: Focus on matters with legal, commercial, and social merit, rather than limiting intake based on clients' ability to pay
- Increase strategic flexibility: Finance long-tail disputes through trial or appeal and avoid settling early due to budget pressure
LexFund: Bridging the Gap Between Attorneys and Funders

Types of Litigation Funding
Single-Case Funding
Capital for one legal matter, often involving high-stakes commercial, antitrust, intellectual property, or complex contractual disputes. Funding typically supports attorney fees, expert witnesses, and trial-related costs.
Portfolio Funding
Capital to support multiple litigation or arbitration matters under a single funding arrangement. Returns are typically linked to recoveries from one or more cases in the portfolio, offering flexibility and risk mitigation for law firms or companies managing several disputes.
Law Firm Lending
Capital provided directly to law firms to support operations, growth, or case-related expenses. Typically structured as recourse lending, with repayment required regardless of case outcomes. Offers flexible working capital backed by the firm's receivables or anticipated fees.
Founding Story
After losing his father to an environmentally-linked cancer, Dylan Ingerman set out to explore why access to justice so often depends on resources rather than merit, especially in cases involving toxic exposure, insurance disputes, and systemic harm. Despite the rapid growth of litigation finance across mass torts, commercial litigation, IP, and antitrust, many strong claims still go unfunded due to persistent inefficiencies and misalignment.
LexFund was built to change that. The platform provides a secure, centralized, and neutral environment where attorneys and funders connect based on key criteria such as investment size, damages, stage, and court type. By streamlining these connections, LexFund lowers the barrier to securing capital for meritorious claims and expands access to justice.
